- Under common law, Let me stop you right there. I think we found the problem. We don't use English Common law, except for the multistate portion of the bar exam. Look to state law. Nevada in this case, IIRC.

- The death penalty only applies to murder cases. Unless there is evidence he murdered someone, the most he can get is life in solitary at a supermax prison.
